The Supreme Court has directed the Election Commission of India to reply to challenges against electoral roll revisions in Tamil Nadu and West Bengal. The court questioned the states' apprehension regarding the process. Senior counsel argued the revision is happening too quickly compared to past practices.

New Delhi: The Supreme Court on Tuesday asked the Election Commission of India (ECI) to respond to contentions raised in six petitions challenging the special intensive revision (SIR) of electoral rolls being undertaken in Tamil Nadu and West Bengal.

Issuing a notice to EC, a division bench comprising Justices Surya Kant and Joymalya Bagchi questioned the "apprehension" of states.

"Why are you people so apprehensive? They (EC) have to answer (to the contentions). It (SIR) is only a preliminary exercise. I think it is a case of rectification of deficiencies...everybody (state governments) wants a status quo (on SIR)," Justice Kant remarked verbally.

In response, senior advocate Kapil Sibal, counsel for DMK, alleged the exercise was being undertaken in a hurry unlike before when it used to take 3 years to revise the rolls.

"This never used to happen before. Earlier, it used to take three years. Now, they (ECI) are saying one month," Sibal vehemently argued.

The Bench shot back orally observing, "It is not an adversarial litigation... You (states) are trying to project as if it is for the first time a voters' list is being prepared in this country". Referring to the ECI, the Bench added "a constitutional authority is doing its duty. The procedure may have procedural deficiencies" but the same can be rectified.
