Buying A Two-Wheeler In UP? 2 Helmets Now Mandatory With Every Purchase
Buying a two-wheeler in Uttar Pradesh will now automatically come with two ISI-certified helmets: one for the rider and one for the pillion. The Uttar Pradesh Transport Department has issued an order making it mandatory for all automobile dealers to sell two ISI-marked helmets with every new two-wheeler.
The directive was circulated on January 14 to all Deputy Transport Commissioners (DTCs), Regional Transport Officers (RTOs) and Assistant RTOs (ARTOs) across the state.
The aim: close the long-standing gap in helmet use, especially among pillion riders.
Why The Government Brought In This Rule
Under the Central Motor Vehicle Rules (CMVR), both riders and pillion riders are legally required to wear ISI-certified helmets. Officials admit that full compliance has never been achieved, despite regular enforcement drives.
Transport department sources say most households own only one helmet, making it easy for pillion riders to skip safety gear. By placing responsibility on dealers, the government hopes to ensure that no new two-wheeler hits the road without two helmets from day one.
“It will create awareness that wearing a helmet for pillion riders is also mandatory," a senior official told the Times of India.
What Dealers Must Do Now
The order makes compliance non-negotiable for dealers. Here's what they are required to do:
Concerned authorities have been instructed to verify helmet receipts before approving vehicle registration.
Steps To Keep Dealers In Check
The Transport Department has directed its enforcement wing to carry out random inspections of dealerships. These checks will ensure that dealers are not bypassing the rule or issuing fake receipts. Any dealer found violating the order could face action under applicable motor vehicle regulations.
Are The Helmets Free?
The law mandates that two helmets must be provided, but it does not necessarily mean they are free. In practice, showrooms may charge for the helmets as part of the sale package and buyers should demand invoice details that clearly list both helmets before completing paperwork.
What If You Insist On Buying Only One Helmet?
If a buyer tries to avoid purchasing the second helmet, the dealer cannot complete the registration process without uploading proof of two helmets sold. In short, no helmet receipt means no registration approval.
You Will Still Be Stopped On The Road
Even after purchase, enforcement doesn't stop.
If either person is found without an ISI-certified helmet, action will follow.
Who Will Catch You?
If seen without two helmets, you will be stopped on the road by Traffic Police, Transport Department Enforcement Officers or special road safety squads.
What Is The Fine For Not Wearing A Helmet?
As per Section 194-D of the Motor Vehicles Act and the Central Motor Vehicle Rules (CMVR), riding a two-wheeler without an ISI-certified helmet attracts a fine of Rs 1,000.
The violator's driving licence can also be suspended for three months. The rule applies to both the rider and the pillion.
What Does ‘ISI-certified' Mean?
An ISI mark indicates that the helmet complies with safety standards set by the Bureau of Indian Standards (BIS) under IS 4151:2015. Only helmets with this certification are considered legal and effective for road use. Cheap non-ISI helmets are unsafe and illegal.
UP's ‘No Helmet No Fuel' Rule
Uttar Pradesh has also moved toward volume enforcement policies such as “No Helmet, No Fuel" at petrol pumps, meaning fuel may be denied to riders not wearing helmets. It started in Lucknow and other districts to boost compliance.
What Quality Checks Are Underway For Helmets Nationwide?
The Department of Consumer Affairs and BIS are actively cracking down on substandard helmet sales. In 2024-25, they seized thousands of non-certified helmets and conducted search-and-seizure operations against sellers of fake or low-quality products.
