J&K court acquits three in terror case
A sessions court in Jammu and Kashmir has acquitted three individuals accused of terror-related activities. The court cited a lack of evidence and significant gaps in the prosecution's case. The accused, Wajid Ahmad Bhat, Masrat Bilal Bhuru, and Rameez Ahmad Dar, were arrested in Srinagar in October 2022. The court found the prosecution failed to prove charges beyond reasonable doubt.
Srinagar: A sessions court in Jammu & Kashmir has acquitted three persons accused of involvement in terror-related activities, citing lack of evidence and major gaps in the prosecution's case. The court of Additional Sessions Judge Manjeet Rai - designated as Special Judge under the NIA Act - held that the prosecution had failed to prove the charges beyond reasonable doubt.
Wajid Ahmad Bhat, Masrat Bilal Bhuru and Rameez Ahmad Dar, all residents of Kulgam district, were acquitted on Monday. The court directed that they be released forthwith if not required in any other case. The accused were represented by advocates Mir Urfi, Waheed Ahmad Dar and others.
The three were arrested at a police checkpoint in Srinagar's Batamaloo area on October 10, 2022. The prosecution alleged that grenades and magazines with live rounds were recovered from their possession.
The court reiterated that in a criminal trial, the prosecution must prove its case beyond reasonable doubt and that "suspicion, however strong, cannot take the place of proof".
"The present case is marked by material discrepancies about how the accused came to be apprehended and what exactly was recovered from whom," the judge observed.
The order noted that bank account scrutiny of the accused revealed no suspicious transactions. "No literature, flags, posters or other material associated with Al-Badr was recovered from their homes or possession, and there is no evidence that the accused were members of any proscribed group or participated in any prior unlawful activities," it said.
The court recorded what it termed "a collective failure to record identifying marks or numbers of the case property and to preserve seal impressions, thereby breaking the chain of custody". It also found contradictory evidence regarding the sealing and presentation of grenades before the bomb disposal squad.
