Uttarakhand: FIR filed after mob protests Hindu man who objected to Muslim shopkeeper’s harassment

The police in Uttarakhand have registered a first information report against unidentified persons after people claiming to be from the Bajrang Dal protested against a Hindu gym owner who had objected to the harassment of a Muslim shopkeeper in Pauri Garhwal district, The Indian Express reported on Sunday.
On January 26, Deepak Kumar was at a friend's shop in the Kotdwar area when he overheard a group of men issuing threats to an elderly shopkeeper, Vakeel Ahmed, and objecting to him using the word “Baba” in the name of his shop. When Kumar intervened, he was asked not to interfere, the newspaper reported.
In a video of the incident that was later widely shared on social media, Kumar is seen questioning the group on why other shops are allowed to use the word “Baba” but Ahmed's shop is not. He is also heard saying that the shop is over 30 years old and asking whether its name should now be changed.
When asked his name, Kumar replied, “My name is Mohammad Deepak.”
“I intended to convey that I was an Indian and that everyone is equal before the law,” Kumar told The Indian Express.
Kumar subsequently posted a video on Instagram, in which he said: “I am neither a Hindu, neither a Muslim, neither a Sikh, nor a Christian. First and foremost, I am a human being. Because after I die, I have to answer to God and to humanity, not to any religion.”
He said that no one, whether a Hindu or a Muslim, should be targeted for their religion.
After the video was widely shared, police received information on Saturday that a group of persons was assembling to confront Kumar at his gym and was also gathering near Ahmed's Baba Dress shop, The Indian Express reported.
Around 40 persons gathered near Kumar's gym and shouted slogans against him. They also blocked the national highway.
The FIR was filed based on a complaint by a police officer who was deployed at the site of the incident. According to the complaint, when police attempted to stop the group, its members raised slogans and blocked the road using the 12 to 15 vehicles in which they had arrived, the newspaper reported.
“[They] began sloganeering using words that hurt religious sentiments,” The Indian Express quoted the FIR as saying.
The group also allegedly removed police barricades. “The group…reached Baba Dress shop and started raising slogans in front of the shop and used abusive language while spreading religious frenzy,” The Indian Express quoted the FIR as saying.
When police forced them to disperse from the area, they regrouped near Malviya Udyan, in front of the Municipal Council on the national highway.
“They blocked the road for about an hour,” The Indian Express quoted the FIR as saying. “By raising religious slogans, they attempted to disturb communal harmony, and created an atmosphere of disorder. They were repeatedly asked to leave, and an atmosphere of fear and panic prevailed among passers-by.”
“Information has been received that most of them had come from Dehradun and Haridwar, and that they were claiming themselves to be members of the Bajrang Dal,” the FIR added.
The FIR was registered on Sunday under sections of the Bharatiya Nyay Sanhita pertaining to unlawful assembly, obstructing public servants in the discharge of their duties and promoting enmity.
Meanwhile, another FIR has been registered against those who allegedly issued threats to Ahmed, the Hindustan Times reported on Sunday.
Pauri Garhwal Senior Superintendent of Police Sarvesh Panwar was quoted as saying that Ahmed filed a complaint saying that he was threatened by persons claiming to be members of the Bajrang Dal, who demanded that he change the name of his shop.
Ahmed identified two of the persons as Gaurav Kashyap and Shakti Singh Gonsai.
Panwar said that based on the complaint, the Kotdwar police have booked the two named persons and unidentified persons under sections of the Bharatiya Nyaya Sanhita, pertaining to voluntarily causing hurt, house trespass after preparation for hurt, assault or wrongful restraint and criminal intimidation and intentional insult with intent to provoke breach of peace.
Commenting on the matter, Congress leader Rahul Gandhi said that Kumar was fighting for the Constitution and humanity.
“The Sangh Parivar is deliberately spreading economic and social poison across the country so that India remains divided and a few individuals can continue to rule through fear,” Gandhi said in a social media post. “The BJP government in Uttarakhand is openly supporting anti-social forces that are engaged in intimidating and harassing ordinary citizens.”
