Supreme Court hearing on SIR updates: Manner of conducting electoral rolls revision must conform to principles of natural justice, says CJI

Justice Bagchi notes that the yearly summary revision was a manifestation of the Parliament's wisdom, as there was constant movement and migration of the population. “There was a lot of flux then. The Parliament knew it would take some years for the population to settle,” he said.

Senior Advocate Rakesh Dwivedi, representing the Election Commission, says the 2025 SIR is sustainable under Article 324 read with Section 21(3) of the Representation of the People Act, 1950.

Justice Joymalya Bagchi says no power or jurisdiction can be untrammelled, no matter how high one is.

Justice Kant adds that the manner of conduct of the revision of electoral rolls must conform with the principles of natural justice. It should be just and fair, he says.

CJI Surya Kant asks Rakesh Dwivedi if special revision may involve serious consequences in the civil rights of a person who is already a voter.

“So, why should we not expect you (EC) to have a transparent procedure,” he says.

The CJI's question is with regard to sub-section (3) of Section 21 of the 1950 Act.

Rakesh Dwivedi refers to clause (3) of Section 21 [Preparation and revision of electoral rolls], which allows the EC to hold a special revision “at any time, for reasons to be recorded” for any constituency or part of a constituency in “such manner as it may think fit”

Rakesh Dwivedi refers to Section 21 of the Representation of the People Act, 1950, to argue that EC can go beyond the limits of its own rules to revise electoral rolls as long as the reasons and procedure are fair and just.

Senior Advocate Rakesh Dwivedi, representing the Election Commission, refers to the provisions of the Representation of the People Act, 1950, to submit that every section in it shows the power to revise is not foreclosed to the EC, but preserved.

The ongoing Special Intensive Revision (SIR) 2.0 was projected as a technology-driven exercise to clean electoral rolls and include every eligible Indian resident. Instead of inspiring confidence, it has triggered widespread fear and anxiety among voters. The experience has exposed a stark mismatch between the Election Commission's (EC) digital capacity and its ground-level execution.

Digitizing SIR verification is crucial to enhance electoral integrity, reduce voter distress, and ensure a fairer process for all citizens.

The Election Commission in the Supreme Court on Tuesday (January 20, 2026) said the order declaring Special Intensive Revision (SIR) was “legislative” in character and the mammoth exercise which followed to “purify” electoral rolls was marked by a “liberal approach”.

The Supreme Court on Monday (January 19, 2026) criticised the Election Commission for the “stress and strain” caused, through its ongoing Special Intensive Revision (SIR) exercise, to the ordinary people of the State of West Bengal, where 1.36 crore people, almost 20% of the population, have received notices from the poll body to explain “logical discrepancies” in their names and family backgrounds.
