Suicide threats by wife can be ground for divorce, amount to mental cruelty: HC
The Chhattisgarh High Court ruled that a wife's repeated suicide threats and pressure on her husband to convert religion constitute mental cruelty. The court upheld a divorce granted to the husband, citing the wife's conduct created constant fear and sustained mental harassment. The couple has been living separately since 2019.
The Chhattisgarh High Court has ruled that repeated threats of suicide by a wife and pressure on a husband to change his religion amount to mental cruelty. The court upheld a family court order granting divorce to a man from Balod district. The wife had challenged the June 2024 divorce order, a report by TOI stated. A division bench of Justices Rajani Dubey and Amitendra Kishore Prasad passed the ruling on Thursday. The court said cruelty is not limited to physical harm and can include “conduct causing reasonable apprehension in the petitioner's mind.”
Suicide threats created constant fear
The court referred to a written complaint filed by the husband at Gurur police station in Balod district on October 14, 2019. In the complaint, the husband reported that his wife repeatedly threatened to die by suicide. The husband told the court that he lived in constant fear due to these actions. The couple had married in May 2018.
During cross-examination, the husband admitted that he left his wife at her parents' home because he feared she might harm herself. The bench observed, “The wife's repeated suicide attempts and threats created a situation of sustained mental harassment for the husband,” and held that such conduct “satisfies the legal test of cruelty”.
Allegation of religious pressure
The High Court also considered testimony from a community representative. The witness stated that the wife and her family pressured the husband to adopt Islam. The wife denied the allegation.The bench said the claim formed part of the overall pattern of conduct examined by the court while deciding the case.
Couple living separately since 2019
The court noted that the husband and wife have been living separately since November 2019. Despite several attempts by the husband and village elders, the wife did not return to the matrimonial home.The wife told the court that she always wanted to resume living with her husband. She also claimed that the husband sought divorce only after she filed cases under Section 125 of the Criminal Procedure Code and the Domestic Violence Act.
However, the High Court held that the overall evidence showed that the wife had deserted the husband without just cause.
The High Court also recorded that the wife continues to receive a monthly maintenance of Rs 2,000 for herself and Rs 2,000 for the couple's minor son. The amount was fixed under an earlier family court order.Add as a Reliable and Trusted News Source Add Now!
