Opposition moves impeachment motion against Madras High Court judge GR Swaminathan
Opposition MPs on Tuesday submitted an impeachment notice to Lok Sabha Speaker Om Birla against Madras High Court Justice GR Swaminathan, saying that the judge's recent orders and actions have been viewed as “disruptive to social harmony and detrimental to integrity of the judiciary”.
The motion seeks the removal of Swaminathan, a judge in the Madurai bench of the High Court, under Article 217 of the Constitution read with Article 124, Live Law reported.
While Article 217 pertains to the appointment and conditions of office for High Court judges, Article 124 prescribes, among other aspects, the removal process for judges.
The motion came against the backdrop of Swaminathan's order directing the authorities of the Subramaniya Swamy Temple at Thirupparankundram in Madurai to ensure that the Karthigai Deepam was lit at the deepathoon, a stone pillar, near a dargah on the top of a hill.
The judgement rejected objections by the temple authorities and the dargah management, and stated that the lighting of the lamp would not infringe on the religious rights of the Muslim community, India Today reported.
On Tuesday, the MPs stated that Swaminathan's conduct had raised serious questions regarding the impartiality, transparency and secular functioning of the judiciary, The Hindu reported.
They alleged that the judge had shown undue favouritism towards a senior advocate and lawyers from a particular community in deciding cases.
“He is deciding cases on the basis of a particular political ideology and against the secular principles of the Indian Constitution,” The Hindu quoted the Opposition MPs as having alleged.
To impeach a judge in Parliament, a removal motion is required to be signed by 100 Lok Sabha MPs or 50 Rajya Sabha MPs.
If the motion is admitted, a three-member judicial committee investigates the matter. The Parliament votes on the impeachment if the committee finds misconduct. If the motion gets two-thirds of the votes, the president is advised to remove the judge.
The 107 signatories included Tamil Nadu's ruling Dravida Munnetra Kazhagam leaders Kanimozhi, Dayanidhi Maran, TR Baalu and A Raja, Congress leaders Priyanka Gandhi Vadra, Gaurav Gogoi and Manickam Tagore, and Samajwadi Party's Akhilesh Yadav and Dimple Yadav.
Nationalist Congress Party (Sharadchandra Pawar) leader Supriya Sule, Shiv Sena (Uddhav Balasaheb Thackeray) MP Arvind Sawant, All India Majlis-e-Ittehadul Muslimeen chief Asaduddin Owaisi and Indian Union Muslim League's ET Muhammed Basheer were among the signatories.
Bharatiya Janata Party leader K Annamalai said that the MPs from the Opposition INDIA bloc will “flaunt their anti-Hindu credentials” as a “badge of honour”.
“...moving an impeachment motion against a judge, despite an appeal already filed by the TN DMK govt before the Honourable Supreme Court, reveals nothing but a desperate attempt to feed their politics of minority appeasement,” the Hindutva party's former state chief said.
“What purpose does this political drama serve, except signalling that the rule of law is secondary to vote-bank politics?” he added.
On Monday, a lawyers' association held a protest outside the Madras High Court complex demanding the impeachment of Swaminathan for his judgement in the Thirupparankundram Deepam case.
