‘New Rent Rules 2026’ Go Viral As Claims Say ‘Tenants Cannot Be Evicted Without…’ — Truth Or Hype? A Fact‑Check
Posts about “New Rent Rules 2026" are circulating widely online where many are claiming that India has introduced major changes to tenancy laws. These posts claim that the government has brought in new regulations around rent, deposits and eviction procedures.
Ever since they have surfaced online, these rules have led to a confusion among tenants and landlords. But while many of the points being shared online are technically correct, the reality behind them is quite different.
Claims About ‘New Rent Rules 2026’
According to posts circulating online, a number of rules have supposedly come into effect this year. The posts claim that landlords cannot charge more than two months’ rent as a security deposit for residential properties. For commercial properties, the deposit
limit is said to be up to six months’ rent.
It is also being said that landlords can revise the rent only after 12 months and must provide tenants with at least 90 days’ written notice before increasing it.
Other Conditions Being Shared Online
Many posts also state that landlords must give tenants at least 24 hours’ written notice before entering a property for inspection or repairs.
Another claim says that if a major repair is required, the tenant must inform the landlord. If the landlord does not address the issue within 30 days, the tenant can carry out the repairs themselves and deduct the cost from the rent.
The posts further claimed that actions such as changing locks, cutting off electricity or water or threatening tenants would now be punishable.
Some reports also mention that rental disputes related to non-payment of rent, property damage or breach of agreement would be fast-tracked and decided by Rent Courts or Tribunals within 60 days.
Why These Claims Are Misleading
While the rules being discussed online appear detailed and balanced, they are not newly introduced laws for 2026.
In reality, most of these provisions come from the Model Tenancy Act (MTA) 2021 which was introduced by the central government as a guideline. The act was meant to serve as a model framework for states and Union Territories while framing or updating their own
rental laws.
Housing and tenancy laws in India are governed by state governments. This means each state has the authority to create or amend its own rental regulations.
In a reply in the Lok Sabha in December 2021, Minister of State for Housing and Urban Affairs Kaushal Kishore explained that land and colonisation fall under the jurisdiction of states.
He further said states and Union Territories had been advised to adopt the Model Tenancy Act either by introducing new laws or by amending their existing rental regulations.
Which States Have Adopted The Model Tenancy Act
According to a reply in the Rajya Sabha in August last year, only a few regions have adopted tenancy laws based on the Model Tenancy Act so far.
These include Assam, Arunachal Pradesh, Andaman and Nicobar Islands, Dadra and Nagar Haveli and Daman and Diu, and Lakshadweep.
The government also said that states such as Andhra Pradesh, Tamil Nadu, Uttarakhand and Uttar Pradesh had already notified tenancy laws based on an earlier draft of the act and were asked to align them with the latest version of the Model Tenancy Act.
But Are There Any Concerns In Model Tenancy Act?
There have been concerns about certain provisions in the Model Tenancy Act and one of them is to provide Aadhaar details while during rental agreements. Many argue that making the Aadhaar mandatory for such purposes could conflict with Supreme Court rulings.
Since the act encourages registration of rental agreements on digital platforms, some believe that placing such personal details online could expose sensitive information about tenants and landlords. Also, some categories of disputes do not have clearly defined timelines which could still lead to delays in certain cases.
