Modi degree case: Delhi HC seeks DU’s reply to delay in filing appeals to disclose PM’s certificate

The Delhi High Court on Wednesday directed the Delhi University to submit its objections regarding the delay in filing appeals against an August order that had set aside the disclosure of details of Prime Minister Narendra Modi's Bachelor of Arts degree from 1978, Live Law reported.
A division bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela granted the university three weeks to submit its response but refrained from issuing notice in the matter.
The court was hearing appeals filed by Aam Aadmi Party leader Sanjay Singh, Right to Information activist Neeraj Sharma and advocate Mohammad Irshad.
The petitioners have challenged the single-judge order of August 25, which had overturned a 2016 directive by the Central Information Commission requiring the university to disclose information about Modi's Bachelor of Arts degree.
At the time, Delhi University had argued that the Right to Information request was politically “motivated”.
The single-judge bench of Justice Sachin Datta had agreed with the university, observing that there was no implicit public interest in the disclosure and stayed the 2016 order, Bar and Bench reported.
The petitioners have now appealed that ruling.
They have argued that two key questions arise: whether the exemption under Section 8 of the Right to Information Act applies to this case and if it does, whether the disclosure should still be allowed in the larger public interest, Bar and Bench reported.
On Wednesday, the division bench also noted that the appeals had been filed after a delay and said it would first consider whether the delay could be condoned before examining the merits of the case.
The bench has listed the matter for further hearing on January 16, 2026.
The Bharatiya Janata Party has claimed that Modi was awarded a BA degree from Delhi University in 1978 and a Master of Arts degree from Gujarat University in 1983. Critics and the Opposition Aam Aadmi Party have alleged that the degrees are fabricated.
Kumar, a Right to Information activist, had sought details about students from Delhi University's BA programme in 1978, including their roll numbers, marks and if they passed or failed the course.
The university's central public information officer denied the request on the grounds that it was “third party information”. The activist then moved the Central Information Commission.
In 2016, the commission ordered the university to release the information. It ruled that Delhi University was a public body and all information related to its degrees was available in the institution's register, which is a public document.
The university had previously argued in the High Court that the roll numbers, names and marks of all students were exempted from disclosure.
