Karnataka HC sets aside charge of outraging woman’s modesty against HD Revanna
The Karnataka High Court has quashed the charge of outraging a woman's modesty levelled against Janata Dal (Secular) leader HD Revanna by a worker employed at his family's farmhouse, reported Live Law on Friday.
Revanna and his son Prajwal Revanna were booked in the case on April 28.
In an order passed on November 19, the High Court upheld the charge of sexual harassment under Indian Penal Code Section 354A against HD Revanna, while quashing the charge under Section 354.
The Janata Dal (Secular) leader had approached the court seeking to quash the first information report against him. However, during the pendency of his petition, the police filed a chargesheet in the matter and a trial court took cognisance of it.
HD Revanna argued before the High Court that cognisance of the alleged offence cannot be taken, as the complaint against him was registered after the three-year limitation period for crimes punishable with imprisonment of three years or less, reported Live Law.
The bench directed the trial court to examine whether cognisance of the sexual harassment charge against HD Revanna can be taken by condoning the three-year delay in filing the complaint, according to The Hindu.
In August, Prajwal Revanna was sentenced to life imprisonment for raping the 48-year-old worker and recording the assault.
He was arrested on May 31, 2024, after returning to Bengaluru from Germany, where he had fled on April 26, 2024. Prajwal Revanna was suspended from the Janata Dal (Secular) on April 30, 2024.
This came after videos of alleged sexual assaults against several women, allegedly recorded by Prajwal Revanna himself, surfaced just before the 2024 Lok Sabha elections. He has since been booked in four different cases.
Three women have accused Prajwal Revanna of sexual assault, while the fourth case against him involves charges of sexual harassment, stalking and criminal intimidation under the Indian Penal Code.
In the case where he was convicted, the chargesheet included sections of the Indian Penal Code pertaining to being in a position of control over a woman and committing rape and repeated rape on the same woman. He also faces charges under the Information Technology Act.
Prajwal Revanna moved the High Court against his conviction and the life sentence in September.
