With a career spanning over two decades marked by constitutional clarity, social empathy, and institutional accountability, Justice Kant is known for landmark rulings on issues such as Article 370, gender equality, free speech, and corruption, Justice Kant brings a blend of experience and a human-centred approach to the apex court.
Born on February 10, 1962, in Hisar, Haryana, to a middle-class family, Justice Kant began his journey in law as a small-town lawyer. Today, at 63, he begins a tenure expected to last nearly 15 months until his retirement on February 9, 2027.
A steady journey through the legal system
Justice Kant studied law in Haryana and later secured the first rank in his Master's program at Kurukshetra University in 2011. His career as a lawyer in Hisar before moving up to argue cases in the Punjab and Haryana High Court.His elevation as Chief Justice of the Himachal Pradesh High Court, and later to the Supreme Court in 2019, followed a steady track record. His name was officially recommended by Chief Justice B.R. Gavai earlier this week.
In the Supreme Court, he has been part of several important benches and has built a reputation for balancing legal principles with real-world concerns.
Focus on rights, fairness and accountability
Throughout his judicial career, Justice Kant has shown interest in issues that affect people directly — from women's rights and workplace dignity to corruption and misuse of power.In the landmark Pegasus spyware case, he noted that citing national security cannot prevent legitimate questions from being asked in court.
He has also spoken clearly against the misuse of free speech, saying “freedom of speech is not a licence to flout societal norms.” Many lawyers and court observers see him as a judge who combines firmness with empathy.
Justice Kant has repeatedly underlined that corruption is a “serious societal threat.” He ordered a CBI investigation into 28 cases involving alleged fraud that impacted homebuyers. He also granted bail to former Delhi Chief Minister Arvind Kejriwal in the excise policy case, stressing the need for investigative agencies to shed the image of being a “caged parrot.”
His judgments have tried to strike a balance between national interest and citizens' rights. In the Char Dham highway case, he acknowledged the project's strategic importance while insisting on environmental safeguards.
He was also part of the seven-judge bench that reopened the Aligarh Muslim University minority status issue, a matter pending since the 1967 ruling.
Since joining the Supreme Court, Justice Kant has contributed to over 300 benches, shaping Indian jurisprudence across criminal, constitutional, and administrative law. He has revisited key issues including the minority status of Aligarh Muslim University and federal powers of governors, demonstrating a commitment to clarity and institutional balance.
As he takes charge today, Justice Surya Kant faces the challenge of guiding the judiciary amid nearly 90,000 pending cases while navigating debates on technology, privacy, and democratic accountability.
Landmark judgments Justice Kant has contributed to
1. Abrogation of Article 370- Justice Surya Kant was part of the bench that upheld the Centre's decision to remove Jammu and Kashmir's special status, a ruling with major constitutional and political impact.2. Sedition Law Put on Hold-He was on the bench that kept the colonial-era sedition law in abeyance and directed that no new FIRs be registered until the government completed its review.
3. Pegasus Spyware Case- Justice Kant was part of the bench that examined allegations of unlawful surveillance through Pegasus and ordered the formation of an independent committee of cyber experts. The bench observed that the state cannot get a “free pass under the guise of national security.”
4. Bihar Electoral Roll Review- He heard petitions challenging the Special Intensive Revision of electoral rolls in Bihar and nudged the Election Commission to disclose details of 65 lakh voters excluded from the draft list.
5. Governor–President Powers Reference- Justice Kant was part of the presidential reference examining the powers of Governors and the President in clearing or withholding state bills. The bench held that the court cannot impose any timelines on Governors and the President to grant assent to Bills passed by state assemblies.
6. Gender Justice and Local Governance- He reinstated a woman sarpanch who had been unlawfully removed, calling out gender bias in the process and highlighting the need to protect grassroots democracy.
7. Reservation for Women in Bar Associations- Justice Kant directed that one-third of seats in bar associations, including the Supreme Court Bar Association, must be reserved for women.
8. Probe Into PM Modi's 2022 Security Breach- He was part of the bench that appointed a five-member committee led by Justice Indu Malhotra to investigate the security lapse during the Prime Minister's Punjab visit.
9. One Rank, One Pension (OROP)- Justice Kant upheld the OROP scheme for the defence forces, calling it constitutionally valid.
