The Supreme Court on Tuesday granted anticipatory bail to Hindutva social media influencer Raushan Sinha, who was booked for allegedly misquoting Congress leader Rahul Gandhi's first speech in Parliament after the 2024 elections, Live Law reported.

Sinha had posted on social media that Gandhi had called Hindus “violent”.

A Congress worker in Telangana had filed a complaint against the post, leading to a case against him for offences relating to public mischief, intentional insult to provoke breach of peace and forgery harming reputation under provisions of the Bharatiya Nyaya Sanhita, the news outlet reported.

A bench of Justices Dipankar Datta and Aravind Kumar set aside a Telangana High Court order of April 3 that had refused him pre-arrest bail.

Noting that the police had filed a chargesheet in June, the Supreme Court said custodial interrogation was no longer needed and granted him anticipatory bail.

It added that Sinha must continue to cooperate with the investigation and should not try to influence witnesses, the court said.

If the terms are not met, the bail would be cancelled, it added.
