The Maharashtra government has intensified its crackdown on bike taxi services by asking Apple and Google to remove ride-hailing apps such as Uber, Ola, and Rapido from their app stores over alleged illegal operations in the state.
The notices, issued on May 15 by the Maharashtra Cyber Department under the Office of the Additional Director General of Police, invoked Section 79(3)(b) of the Information Technology Act, 2000. The tech giants were directed to “remove and disable access” to the applications from both the Apple App Store and Google Play Store.
The move comes after Maharashtra Transport Minister Pratap Sarnaik wrote to the Cyber Department on May 12, seeking intervention against bike taxi platforms operating in the state.
Maharashtra Transport Minister Pratap Sarnaik on Tuesday directed the cyber crime department of the police to shut down unauthorised bike taxi apps operated by aggregators such as Uber, Ola, and Rapido, and to register cases against the owners of these firms.
Bike taxis are currently not permitted to operate in Maharashtra.
According to Maharashtra Cyber, bike taxi services operating through these applications are “unlawful and in violation of the existing legal and regulatory framework”. The notices alleged that the platforms were operating passenger transport services “without obtaining valid permissions, government approvals, or compliance with the rules and regulations prescribed by the Transport Department and the provisions of the Motor Vehicles Act.”
The notices also raised concerns over passenger safety, claiming that driver verification mechanisms, insurance protections, women’s safety measures, and emergency response systems were “highly inadequate”.
“These apps are openly violating government rules while carrying out financial transactions, adversely affecting the livelihood of licensed rickshaw and taxi drivers,” the Transport minister said.
Sarnaik also alleged that app-based bike taxi services do not comply with safety regulations, posing a serious threat to public safety.
“There are no adequate safeguards for passengers using these services, including driver verification, insurance cover, women’s safety measures and emergency response systems,” he said.
“Recently, a serious incident came to light wherein a bike taxi service operated through one of these applications allegedly resulted in the tragic death of a woman. A criminal case has been registered in this regard,” the notices stated, adding that several similar cases had reportedly been registered across Maharashtra.
The notices further warned Apple and Google that failure to comply with directives issued by Indian law enforcement agencies could invite legal action under provisions of the IT Act and intermediary liability rules.
Speaking to The Indian Express, Sarnaik confirmed that the state government had initiated the process through the Cyber Department.
“We have sent letters through Maharashtra Cyber to Google and Apple regarding these apps. Bike taxis are operating illegally in Maharashtra and action is being taken accordingly,” Sarnaik said.
