New CAA Rules Notified: Who Can Grant Citizenship Now & Which States Are Covered?
New CAA rules: This decision, notified by Ministry of Home Affairs (MHA), bypasses the earlier central government-led “Empowered Committees” to fast-track pending applications
Under the newly notified Citizenship (Third Amendment) Rules, 2026, District Collectors (District Magistrates) have been directly empowered by the Central Government to grant or reject Indian citizenship under the Citizenship Amendment Act (CAA).
This decision, notified by the Ministry of Home Affairs (MHA), bypasses the earlier central government-led “Empowered Committees” to fast-track pending applications.

REGIONS COVERED UNDER NEW CAA RULES
The revised mechanism applies to six states and two Union Territories (UTs):
States: Gujarat, Rajasthan, Punjab, West Bengal, Assam, and Tripura.
Union Territories: Jammu & Kashmir and Ladakh.
The tribal areas of Assam and Tripura are strictly excluded from these rules. Under the broader CAA framework, regions governed by the Inner Line Permit (Arunachal Pradesh, Mizoram, Nagaland, and Manipur) and Sixth Schedule tribal areas (including Meghalaya) remain exempt.

The District Collector is now the sole competent authority to receive, scrutinise, verify documents, and completely dispose of applications under Section 6B of the Citizenship Act, 1955.
Previously, applicants submitted cases online to a District Level Committee for basic verification, which was then forwarded to a central Empowered Committee for the final approval or rejection. This slow, multi-layered chain has been eliminated in these jurisdictions to cut down on bureaucratic delays.
The District Collector will now directly administer the mandatory Oath of Allegiance. If an applicant fails to personally appear to take the oath after reasonable opportunities, the Collector will reject the application.
This decentralized rule applies to eligible persecuted minorities (Hindus, Sikhs, Buddhists, Jains, Parsis, and Christians) from Pakistan, Bangladesh, and Afghanistan who entered India on or before December 31, 2014. The Citizenship Amendment Act (CAA) is a law passed in 2019 that fast-tracks citizenship for undocumented non-Muslim migrants from Pakistan, Bangladesh, and Afghanistan.
It specifically applies to Hindus, Sikhs, Buddhists, Jains, Parsis, and Christians who entered India on or before December 31, 2014, to escape religious persecution. The law sparked widespread protests and intense public debate across the country because it excludes Muslims from this fast-track path, which critics argue violates the secular principles of the Indian Constitution.
Supporters and the Indian government maintain that the act is a humanitarian measure designed to protect vulnerable minorities who fled neighboring Islamic republics, clarifies that it does not affect the citizenship of any existing Indian citizens, and officially began implementing its rules in March 2024.
