Can A Foreign Government Legally Arrest A Sitting Head Of State? The Maduro Case Explained

For nearly eight decades, the United Nations has been the world's primary forum for defining the boundaries of lawful state behaviour. From the prohibition on the use of force to the principle of sovereign equality, its Charter created the rules that were meant to prevent unilateral military actions and forced regime changes. Few cases have tested that framework as dramatically as the unfolding crisis surrounding the United States' capture of Venezuelan President Nicolás Maduro.

The world body finds itself drawn into the heart of the dispute because the episode challenges the very norms the UN was created to uphold. Questions about sovereignty, armed intervention and head-of-state immunity are now converging on New York, where the Security Council meets today.

At the centre is a US Special Forces operation that saw Maduro captured in Caracas, transferred to a US warship, and then flown to New York to face long-standing drug-trafficking and narco-terrorism charges. The mission, which Venezuelan officials say involved strikes on military installations and caused casualties, has divided governments and drawn intense scrutiny from legal scholars.

The operation's legality, under both international and domestic legal frameworks, has since become a major point of examination within the international community.

Washington's Legal Argument

The United States has presented the operation as lawful on two fronts. First, American officials argue that Maduro was already under a federal indictment for narco-terrorism and drug-trafficking, and that capturing him was a legitimate law-enforcement action. Second, senior US representatives have invoked Article 51 of the UN Charter, which preserves the right of self-defence.

US Ambassador to the UN Mike Waltz, speaking to Fox News, said Washington viewed Maduro as coordinating with foreign adversaries and armed groups and “pumping drugs, thugs, and weapons into the United States," framing this as a threat that justified action.

That narrative was thrown into uncertainty almost immediately. At a press conference after the operation, US President Donald Trump went beyond a law-enforcement rationale, declaring that the US would “run the country until such time as we can do a safe, proper and judicious transition," and referring to reclaiming American oil interests in Venezuela. Those comments blurred the line between arresting an indicted individual and assuming temporary political control, a shift with serious implications under international law.

Jeremy Paul, a constitutional law professor at Northeastern University, told Reuters the contradiction “doesn't make any sense". He said, “You cannot say this was a law enforcement operation and then turn around and say now we need to run the country."

The UN Charter Problem

At the centre of the legal debate is Article 2(4) of the UN Charter, the post-war rule that forms the backbone of modern international law. It requires all states to refrain from using force against the territorial integrity or political independence of another state. The provision was drafted in 1945 precisely to prevent unilateral military actions that could destabilise international peace.

The Charter recognises only two exceptions. A state may use force if the Security Council authorises it, or the state is acting in self-defence in response to an actual or imminent armed attack, as laid out in Article 51.

Neither condition applied in Venezuela. The US did not seek Security Council approval, and did not present any evidence of an armed attack originating from Venezuela.

This is why many analysts view the operation as inconsistent with the Charter. Geoffrey Robertson KC, a former president of the UN war crimes court in Sierra Leone, told The Guardian that the operation was “contrary to Article 2(4)" and amounted to a “crime of aggression."

The question of self-defence has been particularly scrutinised. Milena Sterio, a professor at Cleveland State University, told Reuters that even if Maduro were responsible for smuggling drugs into the United States, “such smuggling does not constitute an armed attack." Without an armed attack, the legal basis for invoking Article 51 collapses.

This legal framework also explains the reaction from European governments. Many of them opposed Maduro and supported democratic reforms in Venezuela, yet they stopped short of endorsing the US operation. Their statements emphasised the need to uphold international law, with France warning that the method violated principles that govern the use of force, a reflection of the broader concern that exceptions to Article 2(4) cannot be stretched without undermining the Charter itself.

Head-Of-State Immunity And Its Limits

One of the defining principles of international law is that sitting heads of state cannot be subjected to the criminal jurisdiction of foreign courts. This rule, known as head-of-state immunity, exists to ensure that diplomacy and international engagement can function without the threat of politically motivated prosecutions. It applies irrespective of whether a leader is democratic, autocratic, popular or widely criticised.

In practice, this means that foreign courts generally cannot put a serving head of state on trial unless one of two rare conditions is met:

This second scenario shaped the closest historical parallel to the Maduro case. When US forces captured Panama's General Manuel Noriega in 1989, his lawyers argued that he was immune from prosecution as Panama's head of state. US courts rejected the claim because the US government had already recognised another leader — Guillermo Endara — as Panama's legitimate president. In the eyes of the executive branch, Noriega no longer held head-of-state status and, therefore, no longer enjoyed immunity.

The Maduro case is more complex. Although Washington has repeatedly called Maduro “illegitimate" and criticised his governance, it has not formally recognised any alternative head of state. Vice President Delcy Rodríguez has been named acting president by Venezuela's Supreme Court under the constitutional line of succession, but US officials have openly questioned her status. US Secretary of State Marco Rubio said in television interviews on Sunday that he did not view Rodríguez or her government as “legitimate," arguing that Venezuela had not held free and fair elections.

This ambiguity matters because US courts defer to the executive branch when determining who qualifies as a head of state for immunity purposes. Without a formally recognised alternative, courts must decide whether they will accept or reject immunity for a leader who still exercises effective control within his own country.

That uncertainty is why the immunity issue is viewed as one of the most difficult legal questions arising from the case.

The Domestic Law Question

Inside the United States, constitutional questions are also surfacing. Under the US Constitution, Congress holds the sole authority to declare war, while the president serves as commander-in-chief and may order limited military actions in certain circumstances. That balance has long been contested, but major cross-border operations typically fall under congressional scrutiny or at least notification requirements.

In this case, senior US figures have acknowledged that Congress was not informed before the mission. Rubio said in television interviews that lawmakers were not briefed in advance, a detail that has fuelled criticism from across the political spectrum. The issue is not simply procedural; failure to notify Congress raises concerns about whether the president exceeded constitutional limits on the unilateral use of military force.

Legal scholars have also questioned the domestic legal basis for the mission. Matthew Waxman, a law professor at Columbia University, said that “a criminal indictment alone doesn't provide authority to use military force to depose a foreign government," underscoring that domestic law distinguishes sharply between law-enforcement powers and military action abroad.

What Consequences Is The US Likely To Face?

In practical terms: none.

The UN Security Council can impose sanctions or determine breaches of peace, but the United States, as a permanent member, can veto any adverse measure. This structural reality has broader implications. With no mechanism to compel compliance and no prospect of punitive measures, the Council's meeting today is better understood as a forum for political signalling rather than a venue for legal enforcement.

States may articulate their interpretations of international law, challenge the US position, or express concern about the precedent being set, but none of these statements carry binding effect.

A Precedent That Could Reverberate Globally

Some legal experts warn that if the United States faces no consequences, other major powers may feel emboldened to conduct unilateral operations of their own.

Robertson KC told The Guardian that China could cite the Venezuela episode as justification for future action against Taiwan, especially if it refers to similar claims of self-defence or criminality. Domínguez-Redondo, a professor of international law at Kingston University, said that the UN's authority has been “completely dismantled" in cases where powerful nations bypass authorisation.

The legality of the US capture of Nicolás Maduro sits at the intersection of sovereignty, force, self-defence and immunity — the same principles that form the backbone of the UN system. Today's Security Council meeting will not result in sanctions, nor will it alter the fact that Maduro now faces charges in a New York courtroom. But it may shape how governments and courts interpret the operation and how future crises are evaluated.
